I don't think RIR services to Legacy owners/space are really "free".
At least it isn't "zero cost", last time i checked. :-))

You mean, if a LRH sells 50% of their space, the 50% they keep also 
automagically becomes PA/PI? (and "falls" under RIR jurisdiction...?).

It sounds really awkard to me... :-)

Who has the authority to enforce that? The RIR...?
(as far as i can remember, under current policy, the holder/owner, in 
order to receive NCC services always has the choice to "convert" _or_ keep 
the legacy status).
