This argument has been brought up before many times.
The fact that there may be legal ways around sending spam does not mean that
we shouldn't try to make an effort to control the problem in large
jurisdictions (such as the EU). If we don't make the effort, the problem
will just get worse. If we put something like this in place, it will make a
difference.
