Suppose you could 'prove' those parties are not 'legally' entitled to that space and suppose would claim it back. Then what, start handing out that space and have two parties advertising the space? And suppose you could solve that, then what? We buy ourselves how long? How many /8's do you think you could reclaim? How long do you think a RIR like RIPE NCC would be able to survive on a additional /8? I'm a relative newbie in the industry compared to some of us, I started in 1997 (@Demon NL) and in those days we already said "we need to move to IPv6 soon". It's now almost 2017, twenty years later. All what I'm hearing here is 'how can we postpone the inevitable". It's useless, it's inevitable, get over it. Migrate to IPv6, ditch IPv4. Forget about the legacy, it's not going to solve your problem.
