There was an option to get for a number in the 0-65536 range if you specifically asked for it. The text doesn't say that the RIRs cannot give out the numbers in the lower range in other cases. The background was that one estimate showed that we'd be close to the point where all ASN16 were assigned by 1/1/9, so it'd be good to keep the few remaining ones for special cases. In reality, it turns out that we now still have some 14,000 left, so handing out a few more from the <65536 range while we're sorting out how to format the numbers above 65536 doesn't seem to be a big issue to me.
