If I use (abuse) a resource which directly infringes your usage rights,
this behaviour would not fall in this definition because there is not
"another"
resource involved..?

example .. aehh.. like... I use your cpu-time for calculating bitcoins..?
I use your mailserver for spamming?

Maybe I just don't get the english words right :)
