If you want to "ASSIGN" a /40 to the tunnel broker, it falls into the category "assignment of networks larger than a /48 to the end user", and that's paperwork. The way it was meant to be done is doing a sub-allocation (which never goes to "end-users", unlike an assignment), and IPv6 sub-allocations, as far as I understand the policy, don't need to be approved by the NCC beforehand. Of course, when you sub-allocate all of your space away, and the receipients don't use it, you won't be able to get more space for you - so use with care.
